Partner programme terms

These terms apply to everyone accepted into the Trackful partner programme, operated by ECOM FR LLC. They are written to be read: every rule states why it exists, because a rule that is understood gets followed and a rule that is merely imposed gets worked around.
This document describes how the programme works. It is not legal advice and will be reviewed by a lawyer before the programme carries significant volume.
1. Commission
- The rate
- The rate given to you on acceptance is yours for the whole time you take part. If we change the table, the change applies only to partners accepted after it. We never lower a rate already granted.
- What it is calculated on
- Commission is calculated on the amount excluding tax that the merchant actually pays us, discounts included, not on the list price. The first month is discounted thanks to your code, so it pays proportionally less. We write that here rather than let you find the gap on your first statement.
- How long it lasts
- Commission is due for every month an attributed merchant pays a subscription, for as long as they stay. It stops if they cancel and resumes if they return.
- What earns nothing
- A merchant on the free plan, an unpaid month, a refund, and any subscription cancelled or charged back. Commission already paid on a payment that is later refunded may be deducted from the next payout.
2. Attribution
- First touch, 90 days
- The first partner to bring a merchant keeps them, within a 90-day window between first contact and signup. We chose first touch rather than last so that the partner who created the demand does not lose the commission to a site that slips in at the final click.
- One merchant, one partner
- A merchant is attributed once, permanently. Uninstalling and reinstalling does not move them to another partner, in either direction.
- What cannot be attributed
- An install that starts from a search inside an app marketplace carries no trace of you and cannot be credited. Always send your audience to your link, or have them enter your code.
- Your own accounts
- You may not use your code for your own subscriptions or for a company you control. An agency may of course equip its clients’ stores: those are separate merchants with their own subscriptions.
3. Using your code and link
- The code is personal
- Your code is issued to you by name. You may share it with your audience, your clients and your community, in any format.
- No coupon sites
- Posting your code on coupon aggregators, coupon browser extensions or discount directories is not allowed. This is not a comfort clause: a code posted there spreads within days, and the coupon site then gets credited for merchants who came from your own audience. This rule protects you at least as much as it protects us.
- No bidding on our brand
- You may not buy search keywords containing Trackful or close variants, nor use our name in a domain name. Such bidding creates no new demand: it intercepts people who were already looking for us, and makes us pay twice for them.
- No misrepresentation
- You may not present yourself as Trackful, as an official reseller or as an employee, nor promise numerical results that we do not publish ourselves. You may of course say that you use the product, and why.
- Disclose the partnership
- The paid nature of your recommendation must be clearly disclosed. It is a legal requirement in the US and in France, and it is also what makes your recommendation credible.
- Never for a review
- We do not pay for reviews on app marketplaces. Their terms forbid it and it would expose your account as much as ours. We pay for installs, not for ratings.
4. Payment
- Schedule
- A month’s commissions are approved 30 days after that month closes, the time it takes for the refund window to pass, then paid by bank transfer. You get the breakdown per merchant and per period. A refund landing inside those 30 days cancels its commission before it is ever approved: that is exactly what the delay is for.
- Threshold
- A payout is triggered from $50 of approved commissions. Below that the balance carries over to the next month, with no expiry.
- Invoicing
- Depending on your status, we issue an invoice on your behalf or you send us yours. Applicable taxes are yours to handle and depend on your country of residence.
5. Suspension and leaving
- Suspension
- We may suspend a partner who breaches section 3. A suspended code stops granting the discount immediately. Merchants already attributed remain yours and keep generating commission: a suspension is not a confiscation.
- Fraudulent attribution
- We reserve the right to void an attribution obtained through identified coupon traffic, self-referral, or any manoeuvre designed to capture demand you did not create. We will explain why rather than remove a line without a word.
- Leaving
- You may leave the programme whenever you want. Approved commissions remain owed to you. Your code stops working and merchants already attributed stop generating new commission.
6. Data
- What you see
- You see the number of attributed merchants, their plan, and the commission due per period. You do not see their identity, their revenue, or their customers’ data.
- What we keep
- Your name, email, payment details and commission history, for as long as accounting requires. Our privacy policy applies.
