Terms of Service

Article 1 - Purpose

These Terms of Service govern the contractual relationship between ECOM FR LLC, publisher of the Trackful application, and any user subscribing to one of the offered plans.

Trackful is a server-side conversion tracking solution for Shopify and WooCommerce stores, integrating with Google Ads, Meta, Google Analytics 4, TikTok, Pinterest and Snapchat.

Article 2 - Registration and access

Shopify merchants register via the Shopify App Store; WooCommerce merchants install the Trackful plugin and register their site. The user must operate an active store and authorize Trackful to access certain store data.

The user agrees to provide accurate information and keep it up to date.

Article 3 - Free trial

Trackful offers a free 14-day trial including access to all features of the chosen plan. No payment card is required during the trial.

At the end of the trial, the user must subscribe to a paid plan to keep using the service.

Article 4 - Pricing and plans

Current pricing:

  • Starter : €29/mo - up to 10 000 events/mo
  • Growth : €59/mo - up to 50 000 events/mo
  • Pro : €119/mo - up to 200 000 events/mo
  • Enterprise : €0/mo - unlimited events

Prices are exclusive of tax. Applicable VAT is added at billing per current legislation.

ECOM FR LLC may change its prices at any time. Price changes are notified 30 days before they apply.

Article 5 - Billing and payment

Billing is monthly. Shopify merchants are billed via Shopify Billing; WooCommerce merchants are billed via Stripe. Payment is charged automatically.

If the order quota is exceeded, the user is invited to upgrade to a higher plan. No extra overage fee is charged.

Article 6 - Term and cancellation

The subscription is open-ended with monthly billing. The user may cancel at any time from their store interface.

Cancellation takes effect at the end of the current billing period. No pro-rata refund is made for the period started.

Uninstalling the application automatically cancels the subscription.

Article 7 - Money-back guarantee

Trackful offers a 30-day money-back guarantee. If the service does not improve your tracking within the first 30 days after subscribing, we refund you in full on request.

To use this guarantee, contact our support at support@trackful.io within 30 days of your first billing.

Article 8 - User obligations

The user agrees to:

  • Use the service for its intended purpose
  • Comply with the terms of the ad platforms (Google, Meta, GA4, TikTok, Pinterest, Snapchat)
  • Collect their customers' consent in accordance with the GDPR
  • Not use the service for unlawful purposes
  • Keep their login credentials confidential

Article 9 - Trackful obligations

Trackful agrees to:

  • Provide a service available 24/7
  • Maintain 99.9% uptime (Enterprise SLA)
  • Ensure the security and confidentiality of data
  • Provide responsive technical support
  • Update the service regularly

Article 10 - Limitation of liability

Trackful cannot be held liable for indirect damages, in particular loss of revenue, data or customers.

Trackful's liability is limited to the amounts paid by the user over the last 12 months.

Trackful does not guarantee the accuracy of data sent to the ad platforms, which depends on the information provided by the store platform.

Article 11 - Intellectual property

Trackful and all its elements (software, algorithms, interfaces) are the exclusive property of ECOM FR LLC. The user has a non-exclusive, non-transferable right of use for the duration of their subscription.

Article 12 - Data protection

Processing of personal data is governed by our Privacy Policy and Data Processing Agreement. Trackful acts as a processor on behalf of the merchant (the controller) for customer data.

Article 13 - Changes to the Terms

ECOM FR LLC may change these Terms at any time. Changes are notified by email 30 days before they take effect. Continued use of the service constitutes acceptance of the new terms.

Article 14 - Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action.

Failing an amicable agreement, the dispute will be submitted to the competent courts of Paris.
